Terms of Service
These Terms of Service (the “Terms”) govern your access to and use of our website, services, and the embedded website chatbot (the “Chatbot”). By using our services, you agree to be bound by these Terms.
If you do not agree to these Terms, do not use the services. If you are using the services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
1. Service Provider

2. Scope of Services
We provide tools to record, process, and report meter readings, and related support features which may be accessed via the website and the Chatbot. We may enhance, modify, or discontinue features from time to time.
3. Accounts and Eligibility
- You must be at least 18 years old to use the service as a chatbot license owner.
- Provide accurate, complete information and keep it updated.
- You are responsible for safeguarding your account credentials and for all activities under your account.
- Notify us promptly of any unauthorized use or security incident.
4. Acceptable Use
- Do not use the services for unlawful, harmful, fraudulent, infringing, or abusive activities.
- Do not attempt to access non-public areas, interfere with the services, or circumvent technical protections.
- Do not upload malware, spam, or content that violates third-party rights (including IP, privacy, and publicity rights).
- Do not input sensitive personal data into the Chatbot unless explicitly requested for a lawful purpose and with your consent.
- Respect rate limits, API usage policies, and any usage caps we communicate.
5. Chatbot-Specific Terms
- No professional advice: Chatbot content is provided “as is” for informational purposes. It is not legal, medical, financial, engineering, or other professional advice.
- Accuracy: The Chatbot may generate inaccurate or incomplete information. You are responsible for evaluating its outputs before relying on them.
- Human escalation: The Chatbot may route your request to human support. We may review conversation logs to improve service quality and safety.
- Model providers: We may use third‑party AI models and infrastructure as processors to deliver responses, under data processing agreements.
- Content moderation: We may filter, block, or remove content that violates these Terms or our policies.
6. User Content and License
You retain ownership of the content you submit (“User Content”). You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, translate, and display User Content as necessary to provide, maintain, protect, and improve the services and comply with law.
Where permitted by your settings and applicable law, you also grant us a limited license to use de-identified or aggregated data for analytics, quality assurance, and safety improvements. You can request restrictions where required by law.
7. Intellectual Property
We own all rights in the services, including software, design, trademarks, and content (except User Content). You may not copy, modify, reverse engineer, or create derivative works of the services except as permitted by law.
8. Availability and Changes
We strive for high availability but do not guarantee uninterrupted service. We may suspend or limit the services for maintenance, security, or legal reasons, or discontinue features at any time.
9. Third-Party Services
The services may integrate with or link to third‑party services (e.g., hosting, payment, AI model providers). We are not responsible for third‑party services or their policies. Your use of them is governed by their terms.

10. Fees and Payment
Fees are due monthly or annually in advance, depending on the plan. Fees are non‑refundable except as required by law. Prices exclude VAT, which will be added where applicable. We may update pricing with 14 days’ notice. Certain features are provided free of charge. Paid plans are subject to the applicable fees published on our website.
11. Warranties and Disclaimers
To the fullest extent permitted by law, the services are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy, and non‑infringement.
12. Limitation of Liability
Liability. The total liability of TR Automatyka sp. z. o. o., whether in contract, tort, or otherwise, shall not exceed the total fees paid by the Customer to TR Automatyka sp. z. o. o. under these Terms during the twelve (12) months preceding the event giving rise to the claim. In no event shall TR Automatyka sp. z. o. o. be liable for any indirect, consequential, incidental, special, or punitive damages, including loss of profits, data, or business opportunities. For free or trial users, liability is limited to EUR 100.
13. Indemnification
You will defend, indemnify, and hold harmless TR Automatyka sp. z. o. o. and its affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your User Content, your use of the services, or your violation of these Terms or applicable law.
14. Termination
We may suspend or terminate your access if you violate these Terms or if we are required to do so by law. You may stop using the services at any time. Upon termination, Sections that by their nature should survive will remain in effect.
15. Governing Law and Dispute Resolution
These Terms are governed by the laws of Poland, without regard to its conflict of laws principles. Disputes will be resolved by the competent courts located in Warsaw, Poland, unless mandatory law provides otherwise. Consumers may have additional rights under their local laws.
16. Changes to the Terms
We may update these Terms by posting a new version online and notifying Users at least 14 days before the changes take effect. Your continued use after the effective date constitutes acceptance of the updated Terms.
